These terms govern your use of marcusdutoit.com (the "site") and any enquiry, quotation, demo, sale, rental, lease or after-sales support arranged through Marcus du Toit. The site is maintained by Marcus du Toit, Equipment & Truck Specialist at Combined Truck and Equipment Group (CTEG), 1 Jurgens Road, Jet Park, South Africa. By using the site or contacting me you accept these terms.
1. Who you are dealing with
Marcus du Toit acts as a representative of CTEG and the brands CTEG distributes (including Shantui, Powerstar and Foton). Equipment sales, rentals, finance and warranty contracts are concluded with CTEG or the relevant brand principal, not with Marcus personally. This site is a personal brand site to help you reach the right person quickly.
2. Information on the site
Specifications, pricing guides, ROI figures, rental rates, finance examples and article content are provided in good faith for general guidance. They are not a quotation or an offer to contract. Real-world figures vary by configuration, region, hours, attachments, application and finance terms at the time of order. Always confirm with me in writing before making a decision.
3. Quotations and orders
- Written quotations are valid for the period stated on them (typically 7–14 days) and subject to stock, exchange rate and CTEG credit approval.
- Orders are only binding once a CTEG sales order or rental contract is signed and any required deposit is received.
- Delivery dates are estimates unless explicitly committed in the signed contract.
4. Warranties
New equipment carries the manufacturer's standard warranty as published by the brand principal at the date of delivery. Used equipment is sold voetstoots unless a specific written warranty is included in the contract. Warranty claims are handled through CTEG and the brand's authorised service network.
5. Acceptable use of the site
- Don't use the site to break the law, infringe rights, or send spam, malware or abusive content.
- Don't scrape, mirror or republish content at scale without written permission.
- Don't attempt to probe, attack or reverse engineer the site or its infrastructure.
I may suspend access to anyone who breaches these rules.
6. Intellectual property
The site's design, text, photography and branding are owned by Marcus du Toit or used with permission. Brand names and logos (Shantui, Powerstar, Foton, CTEG and others) belong to their respective owners and are used to describe the equipment I sell and support. You may share links to pages on the site; you may not republish substantial content without written permission.
7. Third-party links
The site links to third-party resources (e.g. brand sites, WhatsApp, social platforms, finance houses). I'm not responsible for the content, terms or practices of those third parties.
8. Disclaimer and liability
The site is provided "as is" without warranties of any kind, express or implied. To the maximum extent allowed by South African law, Marcus du Toit and CTEG are not liable for any indirect, incidental, special or consequential loss (including loss of profit, production, data or goodwill) arising from your use of the site or reliance on its content. Nothing in these terms limits liability that cannot be limited under the Consumer Protection Act or other applicable law.
9. Privacy
How I handle your information is set out in the Privacy Policy. By contacting me you consent to that handling.
10. Governing law
These terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in the competent South African courts, without prejudice to your rights under the Consumer Protection Act or POPIA.
11. Changes
I'll update this page when things change and revise the "Last updated" date at the top. Continued use of the site after changes means you accept the updated terms.
